1. Acceptance of Terms

By accessing or using the Arthephage website (the "Site") or placing an order, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.

2. About Arthephage

Arthephage is an e-commerce bookstore based in Tunis, Tunisia, specialising in books, art supplies, kids' products, and curated collections. All transactions are conducted in Tunisian Dinars (TND) unless otherwise stated.

3. Account Registration

• You must be at least 18 years old (or have parental consent) to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.

4. Products and Pricing

We strive to display accurate product descriptions, images, and prices. However, we do not warrant that product descriptions are complete or error-free. In the event of a pricing error, we reserve the right to cancel the affected order and notify you before any charge is made.

Prices are subject to change without notice. All prices are inclusive of applicable taxes unless stated otherwise.

5. Orders and Payment

• Placing an item in your cart does not reserve it. An order is confirmed only upon receipt of a confirmation email from us.
• We accept major credit/debit cards and other payment methods displayed at checkout.
• By submitting payment information, you authorise us to charge your chosen payment method for the total amount of the order.
• We reserve the right to refuse or cancel any order for reasons including product unavailability, suspected fraud, or errors in product/pricing information.

6. Shipping and Delivery

Delivery times are estimates and not guaranteed. Arthephage is not liable for delays caused by shipping carriers, customs, or events outside our control. Risk of loss and title for products pass to you upon delivery to the carrier.

Shipping costs and estimated delivery times are displayed at checkout before you confirm your order.

7. Returns and Refunds

• You may return most items within 14 days of delivery, provided they are in their original, unused condition and packaging.
• Digital products and personalised items are non-returnable.
• To initiate a return, contact us at contact@arthephage.com with your order number and reason for return.
• Refunds will be processed to your original payment method within 7–10 business days of us receiving the returned item.
• Return shipping costs are the customer's responsibility unless the item is defective or incorrect.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Arthephage or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Attempt to gain unauthorised access to any part of the Site or its related systems.

10. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

11. Limitation of Liability

To the fullest extent permitted by law, Arthephage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid for the relevant order.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Tunisia. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts of Tunis, Tunisia.
